Global accessibility, however, is not the same thing as establishing a legal or operational presence in every jurisdiction from which the Archive may be encountered.
This distinction is fundamental to how the institution approaches international growth.
The Archive is globally accessible by design; jurisdictional expansion is deliberate.
Global Accessibility
A person may encounter the Living Archive through search, recommendation, sharing, or ordinary internet access regardless of where that person lives.
Such access does not, by itself, mean that the Living Archive has established an office, business, service, partnership, or other institutional presence in that country.
Deliberate Jurisdictional Activity
Additional consideration is appropriate when the institution intentionally begins activity within a jurisdiction.
Examples may include:
- establishing a local entity;
- employing people locally;
- entering institutional partnerships;
- intentionally marketing services;
- establishing local payment arrangements;
- storing or processing information locally;
- establishing local infrastructure;
- providing services subject to local regulation.
Such activity should be considered deliberately before it is undertaken.
The existence of readers, visitors, or users in a jurisdiction does not by itself constitute intentional establishment or operation within that jurisdiction.
Respect for Applicable Law
Where the Living Archive intentionally operates within a jurisdiction, it seeks to understand and comply with applicable legal and regulatory requirements.
The institution does not assume that a legal framework applicable in one country automatically governs another.
At the same time, it does not attempt to construct an entirely different intellectual identity for every jurisdiction in which its public work can be encountered.
Conflicting Requirements
Different jurisdictions may impose different—and occasionally conflicting—requirements concerning information, expression, privacy, technology, or access.
The Living Archive seeks to address such circumstances through deliberate institutional review rather than improvised editorial decisions.
Where a lawful restriction must be implemented, the institutional preference is for the narrowest practical intervention consistent with the applicable requirement.
Government and Regulatory Requests
Requests from government or regulatory authorities concerning content, personal information, or access should be evaluated according to their authority, legal basis, jurisdiction, scope, and applicable procedural requirements.
The existence of a request does not, by itself, establish that the request is legally binding.
Where appropriate, significant or conflicting requests should receive qualified legal review.
The institution seeks to distinguish legitimate legal obligations from requests that exceed their lawful authority or scope.
Higher-Risk Environments
Different jurisdictions may present materially different conditions concerning censorship, information control, data localization, sanctions, political expression, or internet access.
The Living Archive may therefore apply additional internal review before intentionally establishing services or infrastructure within such environments.
This is a matter of responsible institutional operation, not a judgment upon the people or cultures of those jurisdictions.
No Assumption of Universal Uniformity
The Living Archive does not assume that one legal or political model can simply be imposed upon every society.
Nor does it assume that local compliance requires abandonment of the institution’s underlying intellectual integrity.
The objective is to hold both realities:
respect for applicable law
and
continuity of institutional purpose.
A Deliberate Threshold
The practical standard is simple:
Read globally. Operate deliberately. Collect carefully. Establish locally only with understanding of the obligations that establishment creates.
As the Living Archive’s international activity develops, jurisdiction-specific legal advice may be obtained where the nature or scale of an activity warrants it.
